DISQUALIFICATION & REJECTION

KYN reserves the sole right to disqualify any entry if,

• Contestants are not in Consonance with any and all the terms of this document.
• Contestants have used a music track originally owned by someone else and does not own/possess the required license to use such a music track in the short film submitted.
• Contestants have resorted to making a short film containing any prohibited material. The following is prohibited: kindly refrain from projecting any and all of the following elements. if found to be used in the respective short films, the contestant will be disqualified:

Violence may not be glorified / Involvement of children in violent acts or abuse / Abuse or ridicule of the physically or mentally handicapped / Unnecessary depictions of cruelty to animals / Gratuitous violence, cruelty, or horror / No vulgarity, obscenity, depravity or double entendres / No scenes degrading women / No denigration by race, religion or other social groups / No promotion of sectarian, obscurantist, anti-scientific and anti-national attitudes / Relations with foreign countries should not be affected / No national symbols or emblems, except in accordance with the Emblems and Names (Prevention of Improper Use) Act, 1950 (12 of 1950).

• KYN reserves the sole right to disqualify any Contestant (including the winner) if it has reasonable reasons to believe that the Contestant/winner has breached any of the “T&C” or the Rules and regulations of the Contest as laid down in this document.
• All content used in the short film, including the story, write-up, script, depiction, music, graphics, photographs, images, screenplay, sound records, lyrics, background scores, dialogues, titles, sub titles and all other literary, dramatic, musical and artistic work or any other copyright material therein, should be original and belong to the Participant or be licensed to Participant under a valid license. KYN expressly disavows any responsibility for, and will not be held responsible for, any unauthorized inclusion of any copyrighted content or materials within or relating to the short film, including any content or materials that are or may become the basis for any third-party claims for copyright infringement.
• KYN reserves the right to disqualify any film with any unauthorized inclusion of copyrighted content or materials. In the event that any claim, dispute, action or proceeding shall be brought or asserted by any person or entity alleging that the film makes unauthorized or unlawful use of any copyrighted content or material, the Participant shall fully indemnify and defend KYN and each of their representatives and affiliates from any liability in connection therewith and from any fees and expenses, including but not limited to lawyers’ fees, that any of them may incur in connection therewith.
• KYN shall not be responsible in any manner to anybody including any of the Contestants for the misuse of any video/text submissions at this Contest.
• KYN shall have the right to disqualify any participant who has not abided by the applicable provisions of the Cinematograph Act 1952 and the Cinematograph (certification) Rules 2024.

Please note: KYN’s decision in this regard shall be final and binding.

• The participant must be above 18 years of age and a lawful citizen of India.
• All short films shall be uploaded in the correct format on or before August 31st 2024.
• Each participant shall submit/upload only one short film.
• The Short Film should be in Tamil / English.
• The storyline should stick to the theme given.
• All entries must be accompanied by Poster of the short film (Poster Size - 1280 x 720 pixels and up to 2MB)
• Films once entered cannot be withdrawn
• The duration for the short film must be from 2 minutes - 5 minutes.
• The short film must be original and no watermark of any kind should be on the short film.
• The film must be 1080p quality/ MP4 Format. (2GB Maximum)
• Proper Audio and Color correction is a must, in case of failure to ensure the same, it would lead to direct disqualification.
• It is reiterated herein that the following is prohibited, kindly refrain from projecting any and all of the following elements, if found to be used in the respective short films the contestant will be disqualified:

• Due credits must be given to the cast and the crew in the Short film.
• During the Competition period the short film should not be used in any other Competition/ Social Media site other than Kyn Site/app.
• The jury's decision is final.
• The Company shall retain their respective right, title and interest in and to any copyrights, patents, patent applications, mask works, trade names, logos, trademarks, service marks, trade secrets, moral rights and other proprietary and intellectual property rights of whatever nature (collectively “Intellectual Property Rights”) previously created or owned by it, at all points in time for Top 25 short film.
• All Participants hereby agree that the Company shall have the right to unlimited use and reuse of the Content in a manner that the Company may deem fit including but not limited to, publishing it on the Social Media Platforms, product pages, any third-party promotional activities, marketplaces or across all online paid and non-paid channels in a similar way, During the competition period.
• Any music tracks used by the participants in the short film shall be either originally created by the music director of the concerned short film team, or if it is borrowed from any other music director not being part of the concerned team then the copyright license/right to use such music track should have been duly obtained as per applicable laws by the filmmaker and his/her team before uploading/submitted their short film
• The Participant shall have obtained all necessary licenses, permissions, certifications and authorisations, and has complied with all applicable laws necessary for participating in the Contest.
• The Participant represents and warrants that he or she is not under any contract with any person, firm, corporation or authority that would prevent his/her participation in the Contest and display of short film or any other matter connected therewith and agrees to indemnify KYN against any claim that may be brought against it in this regard or any loss that may be caused due to it.
• KYN shall not be liable for any legal action that may be taken by any third parties to this contest against the Participant or the Short film or KYN, resulting from breach of any of the terms and conditions by the Participant. Arise of such legal actions shall be individually handled and borne by the Participant.
• KYN reserves the right to withdraw or alter the terms of the Contest without prior notice. No correspondence in this regard shall be entertained. All changes shall be posted on the website. It is the responsibility of the Participants to keep themselves informed as to any changes to the Rules and regulations of the Contest.
• Participant, being a user of the platform, agrees to abide and be bound by the terms and conditions and privacy policy of the KYN app and website. Participant shall therefore ensure that the short film falls within the given ambit as per the Terms and conditions and Privacy policy of the KYN app and website.

In case of any controversy on a matter not mentioned in the above regulations, KYN will decide on an appropriate action. KYN’s decision shall be final and binding.
